Dog and Cat Management (Miscellaneous) Amendment Bill –Update 11

The Legislative Council (Upper House) debated the Bill this week. Overall, the Members were positive and supportive of progressing the Bill. Members acknowledged the bipartisan approach, consultation processes undertaken and the advice provided from all stakeholders to assist in developing the Bill. There appears to be strong support for all of the major issues we have discussed (eg mandatory desexing, mandatory microchipping, a breeder register).

 

Several amendments have been proposed, for the Bill. These include:

  •          The definition of Livestock Working dog (LWD) (-there are amendments from both Stephen Wade (Lib) and Rob Brokenshire (Family First))
  •          Whether the definition of LWD appears in the Act or the Regulations  (Wade and Brokenshire).
  •          Whether LWDs are exempt from the obligation to microchip (Brokenshire)
  •          Whether penalties under the Act should be formally reviewed by the Minister every 5 years (Brokenshire)
  •          Whether the whole Act should be formally reviewed by the Minister, 5 years after the Bill passes. The Minister must then table this report in Parliament (Franks).
  •          The definition of desexing (Tammy Franks, Green)
  •          Obligation on anyone who euthanises a dog or cat to report to the Board:

(i) the date on which the dog or cat was euthanised; and

(ii) the location where the dog or cat was euthanised; and

(iii) the method by which the dog or cat was euthanised; and

(iv) the reason why the dog or cat was euthanised; and

(v) any other information reasonably required by the Board; (Franks)

  •          An obligation on the Board to annually report to the Minister the state-wide euthanasia numbers. The Minister must then table this report in Parliament (Franks).
  •          An obligation on Greyhounds SA to report to the Board on euthanasia numbers (Franks).

 

These issues will be resolved, through clause-by-clause debate at Committee stage in the Legislative Council. This is likely to happen on the Parliament Sitting Days, 22-24 March.
